Statutory Declarations & Agreement Terms

1. Policy Governance & Authorization

This policy governs the affiliation, establishment, operation, inspection, and certification of Bhartiya Institute of Technology (BIT) Authorized Study Centers. Affiliation is granted exclusively on a non-exclusive, territorial basis within the approved municipal or local limits specified in the grant letter.

2. Legal Status of Franchisee

The Franchisee operates solely as an independent educational licensee. Nothing in this policy or subsequent agreements shall be construed to create any partnership, joint venture, employer-employee, or principal-agent relationship between BIT Head Office and the Franchisee or its employees.

3. Curriculum, Examination & Certification Control

All syllabi, study materials, examination question papers, online examination portals, marksheets, certificates, and student verification records remain under the strict, centralized authority of BIT Head Office. Franchisees are strictly prohibited from issuing independent unauthorized certificates or altering prescribed course durations.

4. Inspection & Quality Assurance

BIT reserves the unconditional right to conduct unannounced academic, administrative, and infrastructural inspections at any time during regular operational hours. Failure to meet standard norms shall result in show-cause notice or suspension.

Clause 1: Grant & Scope

Subject to payment of applicable affiliation fees and documentary verification, BIT authorizes the Centre to conduct specified vocational and computer courses at the designated premises.

Clause 2: Financial Remittances & Royalties

The Centre agrees to deposit student registration fees, examination fees, and certificate charges to BIT Head Office accounts as per the prevailing official schedule. Any concealment of student enrollments constitutes gross breach of contract.

Clause 3: Brand Identity & Trade Marks

The Centre shall use the BIT logo, trade name, and promotional artwork strictly in conformity with the BIT Brand Identity Manual. Any unauthorized alteration or use of the brand outside the approved center location is strictly actionable.

Clause 4: Termination & Discontinuation

BIT may terminate this agreement forthwith upon: (a) fraudulent student admissions; (b) examination malpractice; (c) non-payment of dues; (d) insolvency or criminal conviction; (e) damaging the goodwill and reputation of BIT.

Clause 5: Jurisdiction & Dispute Resolution

All disputes arising under this agreement shall be referred to sole arbitration appointed by the Director, Bhartiya Institute of Technology. The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996, and courts in Siddharthnagar, Uttar Pradesh shall have exclusive jurisdiction.
